Terms and Conditions

Considering the Coronavirus (Covid-19) outbreak at the end of 2019, Take a Chef extended its cancellation policy by adding a force majeure clause on March 12, 2020, which offered flexibility to clients in case their Private Chef service was canceled due to border closures, flight cancellations, mobility limitations and restrictions.

However, taking into account the progress in vaccination and that local restrictions have made it possible to control the spread of the virus, Take a Chef no longer considers cancellations related to the Coronavirus (Covid-19) to fall within the force majeure category, which means that our regular cancellation policy will apply:

  • For reservations canceled up to 30 days before the time of the reservation: the full value of the reservation will be refunded*
  • For reservations canceled between 8 and 29 days before the reservation: guests have the option to choose between receiving a 50% refund of the value of the reservation* OR rescheduling the reservation with the same chef within the following 90 days.
  • For reservations canceled less than 7 days before the service date: a refund does not apply*

*In case a refund applies, Take a Chef will retain 3% of the total service that covers the non-refundable transaction fees.

  • 1. Our cancellation policy seeks to protect the guest and the chef alike. The client can receive the full amount of their reservation if the cancellation is made at least one month in advance as this will give the chef enough time to find a new client for the date.
  • 2. The client will be able to decide between receiving a 50% refund or rescheduling the experience with the same chef within the next 90 days in case the cancellation occurs between 8 and 29 days before the service. This guarantees that the client does not lose the total amount of their reservation and that the chef is able to cover any expenses incurred.
  • 3. In the event that the cancellation is made less than 7 days in advance, the client will not be eligible for any type of refund since the chef has already incurred in expenses for the service in addition to rejecting other potential clients for the date.

1. Description

Take a K2K SL (hereinafter referred to as “Take a Chef”) has developed an advertising intermediation platform that can be accessed from the website www.takeachef.com, designed to put in CGUch diners who wish to contract private chef services with chefs offering their services as independent providers of such services.

These terms and conditions are intended to regulate access and terms of use of the Platform. Please read these conditions carefully. You understand and acknowledge that Take a Chef is not a party to any contract, agreement or contractual relationship, of any kind, signed between the Users of its Platform.

By registering with an email address, you acknowledge that you have read and accepted these general conditions of use.

2. Definitions

In this document:

CGU: Means current General Terms and Conditions of Use.

Chef: Means the User who uses the Platform to offer their private chef services in exchange for a price freely agreed between the parties (chef and diner).

Diner: Means the User who uses the Platform to request a private chef service and eventually contracts the services of a Chef, agreed between the parties.

Confirmation of the reservation: It has the meaning attributed to it in Article 4.2.1 below.

User-developed content: Has the meaning attributed to it in Article 11.2 below.

Account: Means the account that must be created in the Platform to be a User and to be able to access the Services that are requested and offered by Users in it.

Management expenses It has the meaning attributed to it in Article 5.2 below.

Messages: Means the shared communications between chef and diner through the Platform during the offer process prior to the Reservation.

Menu: Means the specific content of the offer in order to provison the private chef services, made by the chef to the diner in response to the request registered by the diner through the Platform, it includes both the specific menu proposal and any shared messages with the diner in relation to the service offered.

Offer: Means the content of the provision of services offered freely and independently by the chef to the Diner in response to a Request, it includes both the Menu and the Messages exchanged between the chef and Diner.

Chef Profile: It means all the information uploaded by the Chef to the Platform related to his user profile, including both text and Images, and which will be visible both in his public chef profile and every time the Diner receives an Offer from the Chef.

Platform: Has the meaning attributed to it in Article 1 above

Price: It means the sum of the Chef's Fee and the Management Expenses, and it is the amount that the Client pays through the Platform to confirm a Reservation.

Reservation: Has the meaning attributed to it in Article 4.2.1 below.

Service: Means the object of the contractual relationship between the Chef and Diner, based on the provision of a gastronomic service specified in an Offer, with conditions freely established between the parties.

Website: Means the website that can be accessed from the address https://www.takeachef.com.

Request: Means the request for a private chef service by a Diner through the Platform.

Take a Chef: Has the meaning given to it in Article 1 above.

Chef's Fee: It means the sum that the chef receives after the execution of the service, discounting the Management Expenses from the Price.

User: Means any person who has created an Account on the Platform;

3. Registration on the Platform and creation of an Account

3.1. Registration conditions on the Platform

The Platform can only be used by people over 18 years of age. Registration on the platform by a minor is strictly prohibited. By accessing, using or registering on the Platform, you confirm and guarantee that you are over 18 years of age.

3.2. Creating an Account

The Platform allows Users to request and offer the provision of Private Chef Services with the ultimate aim of confirming a Reservation through the Platform. In order to request or offer these Services, it is necessary to register on the Platform as a User, either as Chef or Diner respectively.

To register on the Platform it is necessary that you have read and accepted these CGU and the Privacy Policy.

By creating your Account, regardless of the method selected, you agree to provide true and accurate information, and to update said information through your profile or by sending a notification to Take a Chef, in order to guarantee its relevance and accuracy for the entire duration of your contractual relationship with Take a Chef.

In the event that you register using an email, you agree to keep the password selected during the creation of your Account a secret and not to communicate it to any other person. In case of loss or disclosure of your password, you must notify Take a Chef immediately. You are solely responsible for the use of your Account by third parties, unless you have expressly notified Take a Chef of the loss, fraudulent use by a third party, or the disclosure of your password to a third party.

Remember not to create or use, under your own identity or under the identity of a third party, any additional Account to the one created initially.

3.3. Verification

Take a Chef may, for transparency purposes, to improve veracity or to prevent or detect fraud, establish a system to verify part of the information provided in your profile. It basically refers to those cases in which you enter your phone number or provide us with an Identity Document.

You acknowledge and agree that any reference on the Platform or the Services to “certified” information, or to any other similar term, only means that a User has successfully passed the verification procedure existing on the Platform or the Services to provide more information about the User with whom you are planning to share a Journey. Take a Chef cannot guarantee the veracity, reliability or validity of the information subject to the verification

4. Use of the Services

4.1. Posting Ads

4.1.1. Diners

As a Diner, as long as you comply with the conditions established in these CGU, you can request a Service through the Platform, entering the information related to the Service you require (date, location, type of cuisine, etc.) and registering as a User before finishing registering your Application.

By registering your Request, you will receive an email notification with your contact details as User and your password to access the Platform. Once registered, you can make proper use of the Platform, always with the sole objective of booking a Service through it.

4.1.2. Pax

As a Chef, as long as you meet the conditions established below, you can offer private chef services to Diners who register a request in your area.

You can only respond to a Request with your Offer if you meet each and every one of the conditions indicated below:

  • (i) you are of legal age.
  • (ii) you have extensive professional experience in the gastronomic field as a cook, minimum of 5 years.
  • (iii) you have the legal regulations on food handling, hygiene and sanitary conditions, and therefore you are in possession of the appropriate licenses.
  • (iv) you comply with the legal requirements demanded by the current local labor legislation, either as a mercantile company or as a self-employed worker.
  • (v) you have civil liability insurance against any damage that may occur in the provision of private chef services, concerning to eventual food poisoning, as well as damage to movable and immovable property used during the provision of services, as well as to damage to real property that is in the domicile of the Diner and that could suffer damage during the time you are managing the Service.
  • (vi) you comply with the applicable legislation in your territory regarding the transport of raw materials, cooked or not, guaranteeing the hygiene and food safety conditions required by the corresponding authority within the geographical location where the Service is provided.
  • (vii) you use utensils in good conditions and take the necessary measures to guarantee their correct hygiene.
  • (viii) you guarantee the good condition of the raw materials used during the provision of services.

You acknowledge that you are solely responsible for the content of the Offer that you submit through the Platform. Therefore, you acknowledge and guarantee the veracity and precision of all the information included in your Menu and Messages, and you agree to perform the Service under the conditions described in your Offer.

Your Offer, which must comply with these CGU, will be sent to the Diner in response to their Request. Take a Chef reserves the right, at its sole discretion and without prior notice, not to send or delete, at any time, any element of the Offer that does not comply with these GTC or that it considers may damage its image or the image of the Platform.

4.2. Booking a Service.

4.2.1. Service reservation procedure

Take a Chef has established a system for the reservation of online services (“Reservation”) through the Platform.

In order to book a service through Take a Chef, it is necessary that (1) the Diner submits a Request on the Platform, which will be automatically forwarded to the Chefs available at the location set by the Diner, (ii) that at least one Chef will send a proposal to that Request and (iii) that the Guest pays the Price set by the Chef through the Platform.

Once there is a specific Request and Offer, and both users have agreed to the conditions of the Service, the Diner can book it through the Platform paying the full amount set by the Chef in his Offer, using any of the payment methods established in the Platform.

Take a Chef does not intervene in any phase of the Reservation process, leaving the parties free to confirm each and every element of the Service. From the submission of the Request, to submission of the Offer and the confirmation of the Reservation, each and every one of the phases of this Reservation process are confirmed by the parties concerning the Price and conditions of the Service.

Once the Reservation has been made, automatically both users (Diner and Chef) will receive an email notification confirming the Reservation and detailing the contact details of the other party, in order to communicate more comfortably by telephone contact or email.

4.2.2. Nature of the reservation of the Services and terms of use of the Platform on behalf of a third party

Any use of the Platform, both as a Diner and as a Chef, is related to a specific name. The identity of the Chef and the Diner must correspond to the identity communicated by them to Take a Chef.

Therefore, it is prohibited to send an Offer to a Diner on behalf of any other Chef who is not the same User issuing the Offer.

4.3. Evaluation system

4.3.1. Function

Take a Chef encourages you as a Diner to publish your opinions about a Chef after enjoying a Service contracted through the Platform.

4.3.2. Moderation

You acknowledge and agree that Take a Chef reserves the right not to publish or to eliminate any evaluation that considers its content to be in breach of the provisions of these CGU.

4.3.3. Limit

Take a Chef reserves the right to suspend your Chef Account, limit your access to the Platform, or terminate these CGUs if (i) you have received at least three reviews and (ii) the average opinions you have received have a score of 3 or less

5. Financial conditions

Access and registration on the Platform, as well as sending Requests and Offers, do not imply any cost. However, the Reservation will be confirmed after the corresponding payment of a Price, under the conditions described below.

5.1. Price

5.1.1. Specific conditions for the Chef

When submitting an Offer through the Platform, you must provide complete and accurate information about your Service (such as the additional services included, the price for each range of diners, etc.). You are responsible for keeping the information of your Offer updated at all times, and cancel it if it is no longer available by the indicated date.

You are exclusively responsible for setting a Price (including Taxes, if applicable) in your Offer. When setting the Price, and before submitting your Offer, the Platform will always indicate the percentage corresponding to Management Expenses. This way, you can set the Price you deem appropriate, and for greater clarity you will have a calculation table that will show you which final amount of the Price you set corresponds to the Chef's Fee and to Management Expenses. Once a Diner reserves your Offer, you will not be able to demand that the Diner pay a Price higher than the one set in your Offer.

The images used in your Chef Profile must accurately reflect the quality and condition of your Services. Take a Chef reserves the right to require that your Chef Profile have a minimum number of Images of a certain format, size and resolution.

The allocation of Requests within the Platform may vary and depends on various factors, such as the preferences of the Diner, the Price and availability of dates, the number and quality of the Images, the Comments and Evaluations, the type of Chef Service and / or ease of booking.

When you send the Offer in response to a Request and the Diner confirms the Reservation, you will be signing a legally binding contract with the latter, which forces you to provide the Service in accordance with the conditions described in your Offer. You also agree to pay the corresponding Management Expenses and Applicable Taxes.

Take a Chef recommends that Chefs take out adequate insurance for the Service provided to the Diner. Please review the corresponding insurance policy carefully, and make sure in particular to know and understand any exceptions and reductions that may apply to said insurance policy, including, without limitation, whether or not it covers the actions or inactions of the Diners. during the Service.

The chef will be responsible for generating an invoice to the diner for the total amount paid. Take a Chef, for its part, will send the chef an invoice for the management costs.

You acknowledge and agree that Take a Chef may request invoices from you to process specific payments.

5.1.2. Specific conditions for the diner

As a Diner, you can book a Service through the Platform following the corresponding reservation process. Upon receipt of a Booking confirmation by email from Take a Chef, a legally binding contract is formed between Comensal and Chef, subject to any terms and conditions agreed between the parties. Take a Chef will charge the Price agreed by the parties at the time of the Reservation.

If you book a Service on behalf of several people and one of them is a minor, you declare and guarantee to be legally authorized to act on behalf of the minor. Minors can only participate in a Service if they are accompanied by an adult who is responsible for them.

5.2. Management fees

Take a Chef will charge Management Fees for the use of the Platform, always calculated as a percentage based on the price set by the Chef in his Offer. Said percentage will always be visible to the Chef when establishing the Price of his Offer, and prior to sending it. The Management Expenses will be charged at the moment of confirming the Reservation.

The methods for calculating the Management Expenses and the applicable VAT will vary according to the geographical location of the Service and the applicable legislation.

5.3. Price rounding

You acknowledge and agree that Take a Chef may, at its sole discretion, round up or down the Management Fee.

5.4. Payment and repayment methods of shared costs to the coordinator

5.4.1. Authorization to recover

By using the Platform as a Chef, you grant Take a Chef an authorization to collect the amount corresponding to the Management Fees on your behalf and in your name.

Consequently, after the Diners’ Reservation, Take a Chef collects the total amount paid by the Diner. The amount corresponding to the Chef's Fee received by Take a Chef is deposited in an account dedicated to the payment of Chefs’ services.

You acknowledge and agree that none of the aforementioned amounts received by Take a Chef on behalf of the Chef entitle you to the collection of interests. You undertake to respond with due diligence to any request from Take a Chef, and in general, to any competent administrative or judicial authority, especially in relation to the prevention of money laundering. You fundamentally agree to provide, upon request, any evidence of your address and/or identity that may be useful.

In case of lack of response to such requests, Take a Chef may take the measures it considers necessary, such as freezing the amounts paid and/or suspending your Account or resolving these GTU.

5.4.2. Payment of the Chef's Fee

After the Service, Users will have a period of 24 hours from the time the Service has ended to submit a claim to Take a Chef about it. In the absence of a complaint from the Users during this period, Take a Chef must consider the Service confirmed.

From the moment of this express or tacit confirmation, you will have, as Chef, a credit to be credited to your Account. This credit corresponds to the total amount paid by the Guest at the moment of confirming the Reservation after having subtracted the Management Fees.

The payment order in your name will be sent on the first working day after the execution of the Service (as long as Take a Chef has your bank information).

Once the applicable time limits have expired, any amount that has not been claimed will be considered as belonging to Take a Chef.

6. Cancellation Policy

6.1. Payment refund conditions in case of cancellation

The cancellation of a Service will be subject to the following:

  • In the event that the cancellation is made by the Chef, the Diner will be refunded in full.
  • In case of cancellation by the guest:
    • If the guest cancels the service more than 30 days in advance, the guest will be entitled to a full refund of the reservation.
    • If the guest cancels the service more than 8 days in advance and less than 29 days before the time set for the service, the guest will only be entitled to a 50% refund of the amount paid (the remaining will be paid to the chef), OR will have the option of reschedule the reservation with the same chef within the following 90 days
    • If the guest cancels the service less than 7 days before the scheduled date, there will be no refund to the guest. The chef will receive the Service Fee established in his proposal, and Take a Chef will keep the Management Expenses.

Take a Chef reserves the right to assess, according to the information available, the legitimacy of the refund requests.

In the event that a refund applies, Take a Chef will retain 3% of the total service cost that covers the non-refundable transactional fees.

6.2. Refund deadlines

In case that the Client wishes to make a claim regarding a contracted Service, they must contact Take a Chef within the next 24 hours starting from the date and time scheduled for the execution of the Service.

Once said period has elapsed, if the object of the Client's claim was the refund of the amount paid when contracting the Service for any reason or defect related to its execution, even when said reason or defect was not the responsibility of the Client, and as long as the Service had already been paid to the Chef, the claim will be denied.

6.3. Right of Withdrawal

In accordance with the provisions of Article 103 a) of the General Law for the Defense of Consumers and Users, you will not have the right of withdrawal from the moment of delivery of the Confirmation of reservation, as long as the Contract between you and Take a Chef, consisting of contacting another User, has been executed in its entirety.

7. Behaviour of Platform visitors and Users

7.1. Commitment of all visitors to the Platform

You acknowledge that you are solely responsible for complying with all laws, regulations and obligations applicable to the use of the Platform.

  • (i) not to send to Take a Chef (especially at the time of the creation or the update of your Account) nor to the other Users of the Platform false, confused, malicious or fraudulent information;
  • (ii) not to speak or behave or publish any content on the Platform that may be defamatory, offensive, obscene, pornographic, vulgar, offensive, aggressive, inappropriate, violent, threatening, harassing, racist or xenophobic in nature, or that has sexual connotations, incites violence, discrimination or hatred, or that encourages activities or the use of illegal substances or in a more general way that is contrary to the objectives of the Platform and that may infringe the rights of Take a Chef or a third party, or that may be contrary to good customs;
  • (iii) not to infringe the rights and not to harm the image of Take a Chef, in particular with regard to its intellectual property rights;
  • (iv) not to open more than one Account on the Platform and not to open an Account on behalf of a third party;
  • (v) not to attempt to circumvent the online booking system of the Platform, mainly by trying to send to another User your contact information to make the booking outside the Platform in order to avoid the payment of the Management Fees;
  • (vi) not to contact another User, through the Platform, for any purpose other than defining the conditions of the private chef service;
  • (vii) not to accept or make payment outside the Platform;
  • (viii) to comply with these GCS and the Privacy Policy.

7.2. Commitments of the Chefs

When you use the Platform as a Chef, you commit to:

  • (i) to respect all laws, regulations and codes regarding the activity of private chef, especially to have liability insurance in force at the time of the Service;
  • (ii) verify that your insurance policy covers the services offered in each Offer sent to the Customer;
  • (iii) not assume any risk during the performance of the Service, nor take any product or substance that may adversely affect your care and due diligence required by the activity of the Service itself;
  • (iv) to execute the Service as described in the Offer and to respect the times and places agreed with the Guest;
  • (v) use utensils in good condition, complying with all legal regulations in this area, especially those relating to hygiene;
  • (vi) to use raw materials in perfect condition, which comply with the sanitary requirements demanded by the current legislation applicable to the matter;
  • (vii) comply with the legal regulations on food transport, especially those referring to the respect of the cold chain;
  • (viii) not to send any Offer to those Requests that you are not going to execute personally;
  • (ix) ensure that Diners can contact you at the telephone number registered in your profile
  • (x) not have any contraindication or medical incapacity to perform the activity of the Service;
  • (xi) behave appropriately and responsibly during the Service, in accordance with these GTU.

7.3. Commitments of Diners

When you use the platform as a diner, you commit to:

  • (i) communicate to Chef any changes or modifications regarding the conditions of service agreed on the Platform;
  • (ii) ensure that Chef can contact you at the telephone number registered in your profile;
  • (iii) to communicate to Take a Chef, or to any Chef who requests it, your identity card or any other document that proves your identity;
  • (iv) inform the Chef of any relevant information that he/she should know about the real and personal property that he/she will have to use/occupy during the Service, especially in case of countertops, walls, glass, glass-ceramics or any other equipment that could be damaged during the execution of the Service;
  • (v) provide the Chef with the dishes, glassware, cutlery and other utensils that are necessary to carry out the Service;
  • (vi) wait for the Chef at least 30 minutes after the appointed time.

In the event that you have made a Reservation on behalf of a third party, in accordance with the provisions of the previous Article 4.2.3, you guarantee that said third party will respect the conditions established in said Article and, in general, these GCS. Take a Chef reserves the right to suspend your Account, to limit your access to the Services or to terminate these GTU in the event of non-compliance by the third party on whose behalf you have reserved the Service in accordance with these GTU.

8.Suspension of accounts, limitation of access and termination

You can terminate your contractual relationships with Take a Chef, at any time, for free and without having to explain why. To do this, simply go to the "My Account" section and select "Delete Account".

In the case of (i) non-compliance on your part of these CGU, including, among others, the non-compliance of your obligations as a User as established in Articles 6 and 8 above, (ii) exceeding the limit established above in Article 4.3.3, or (iii) in the event that Take a Chef has any real reason to believe that it is necessary to protect their safety and integrity,of the Users or third parties, or for the purposes of fraud prevention or investigations, Take Chef reserves the right to:

  • (i) rescind the CGUs that link you to Take a Chef immediately and without prior notice; and/ or
  • (ii) avoid the publication of, or delete any opinion, message, content, reservation request or any content that you have published on the Platform ; and/or
  • (iii) limit your access to and use of the Platform and/or
  • (iv) temporarily or permanently suspend your Account

In the case of (i) non-compliance on your part of these CGU, including, among others, the non-compliance of your obligations as a User as established in Articles 6 and 8 above, (ii) exceeding the limit established above in Article 4.3.3, or (iii) in the event that Take a Chef has any real reason to believe that it is necessary to protect their safety and integrity,of the Users or third parties, or for the purposes of fraud prevention or investigations, Take Chef reserves the right to:

9. Personal Data

In the context of your use of the Platform, Take a Chef will collect and process your personal information. By using the Platform and registering as a User, you acknowledge and accept the processing of your personal data by Take a Chef in accordance with applicable legislation and the provisions of the Privacy Policy.

10.Intellectual property

10.1.Content published by Take a Chef

Subject to the content provided by its Users, Take a Chef is the only owner of all intellectual property rights related to the Service, the Platform, its content (specifically the texts, images, designs, logos, videos, sound, data and graphics) and with the software and databases that ensure its operation.

Take a Chef guarantees you a personal, non-exclusive and non-transferable right to use the Platform, for your personal and private use, and in accordance with the purpose of the Platform and these CGU.

It is totally forbidden to use or exploit the Platform, including its content, for any purpose other than that foreseen without the prior written consent of Take a Chef. Specifically, the following is totally prohibited:

  • (i) reproduce, modify, adapt, distribute, publicly represent and disseminate the Platform and all its content, except with the prior express authorization of Take a Chef;
  • (ii) decompile and reverse engineer the Platform, with the exceptions stipulated by the applicable texts;
  • (iii) extract or attempt to extract (specifically using data extraction robots or similar data collection tools) a substantial part of the Platform's data.

10.2.Content published by the User on the Platform

In order to allow the provision of the Services, and in compliance with the objective of the Platform, you grant Take Chef a non-exclusive license to use the content and data that you have provided in the context of using the Platform (hereinafter referred to as "User-Developed Content"). In order to allow Take a Chef to distribute through the digital network and in accordance with any communication protocol (especially the Internet and mobile networks) and to be able to offer the platform content to the public, you authorize Take a Chef to reproduce , represent, adapt and translate your User-developed Content for the entire world and for the entire duration of your contractual relationships with Take a Chef, in accordance with the following:

  • (i) You authorize Take a Chef to reproduce all or part of your Content developed by the User in any digital recording medium, known or to be known, specifically on any server, hard disk, memory card or other equivalent medium, in any format and through any process, already known or to be known, to the extent necessary for any storage, backup, transmission or download operation related to the operation of the Platform and the provision of the Service;
  • (ii) You authorize Take a Chef to adapt and translate its User-developed Content, and to reproduce these adaptations in any digital medium, known or to be known, established in point (i) above, with the aim of providing the Services in different languages. This right includes the option to make modifications to the format of your Content developed by the User, with respect to your moral right, in order to respect the graphic design of the Platform or to make your Content technically compatible with our software for subsequent publication through the Platform.

11. Take a Chef function

The Platform constitutes an online network connection platform in which Users can both request and offer private chef services through Requests and Offers accordingly.

By using the Platform and accepting these CGUs, you acknowledge that Take a Chef is not part of any formalized agreement between you and the other Users.

Take a Chef has no control over the behavior of its Users and the users of the Platform. It does not exploit, supply or manage any of the services included in the Offers, and does not offer Services on the Platform.

You acknowledge and agree that Take a Chef does not control the validity, veracity or legality of the Offers sent / received. In its capacity as an intermediary, Take a Chef does not offer any gastronomic service or act as a supplier. The Take a Chef function is limited to facilitating access to the Platform.

The Users (Chefs or Diners) act under their sole and total responsibility.

In its capacity as an intermediary, Take a Chef will not be held responsible for any incident that occurs during a Service, especially in relation to:

  • (i) wrong information communicated by the Chef in his Offer, or by any other means, regarding the Service and its conditions;
  • (ii) the cancellation or modification of a Service by a User;
  • (iii) the behavior of its Users during, before or after the Service.

12.Operation, availability and functionalities of the Platform

Take a Chef will try as much as possible to keep the Platform running smoothly 7 days a week and 24 hours a day. However, it is possible that access to the Platform may be temporarily suspended, without prior notice, for technical reasons, maintenance, migration or update operations, or due to supply cuts or restrictions related to network operation.

Furthermore, Take a Chef reserves the right to modify or suspend access to the Platform or its functionalities, in whole or in part, at its discretion, either temporarily or permanently.

13.Modification of the CGU

These CGUs and the documents integrated by reference form the complete agreement between you and Take a Chef regarding the use of the Platform. Any other document mentioned on the Platform (Frequently Asked Questions, for example), is for indicative purposes only.

Take a Chef may modify these CGU to adapt them to your technological and commercial environment, and to comply with current legislation. Any modification made in the CGU will be published on the Platform indicating the date of entry into force, and you will receive notification of such change before its entry into force.

14. Applicable law - Litigation

These CGU have been drafted in Spanish, in accordance with Spanish legislation.

If necessary, you can also submit your claims regarding our Platform on the European Commission's online dispute resolution platform, which you can access from the following link. The European Commission will send your claim to the competent national authority. In compliance with the legislation applicable to arbitration, you have the obligation, before requesting arbitration, to inform Take a Chef in writing of any claim or dispute in order to obtain a friendly settlement.
